Morning Wire XX
[0] Texas Governor Greg Abbott continues to hold firm in his state's southern border standoff with the Biden administration.
[1] The immigration system and the border issue is the primary issue in America right now.
[2] This is an issue upon which Joe Biden gets a grade of F and deserves to be fired.
[3] We break down where things stand on the ground as well as the political fallout across the country.
[4] I'm Daily Wire, editor -in -chief John Vickley with Georgia Howe.
[5] It's Friday, January 26th, and this is Morning Wire.
[6] The showdown in Texas comes after the Supreme Court ruled in favor of the federal government against the state.
[7] We speak to a legal expert who says this issue is far from settled.
[8] It's a standoff, it's a bit of a race, but the ultimate decision still needs to be decided on the merits.
[9] And shelters in two major sanctuary cities are completely full, leading officials to get creative with housing illegal migrants.
[10] This is the Biden administration's making, and unfortunately, it's been put on state and city governments to solve.
[11] Thanks for waking up with Morning Wire.
[12] Stay tuned.
[13] We have the news you need to know.

[23] The crisis at the southern border continues to escalate between Texas Governor Greg Abbott and President Joe Biden.
[24] Republican governors across the country are rallying to Abbott's defense, while Democrats push Biden to take control.
[25] Daily Wire reporter Tim Pierce is here to talk about what's happening the southern border.
[26] So, Tim, some battle lines are being drawn.
[27] Where do things stand?
[28] That's right.
[29] Abbott has doubled down on border deterrence despite his recent loss at the Supreme Court.
[30] And many governors have backed him since.
[31] Over two dozen GOP governors have put out statements in support of Abbott and that accused Biden of abandoning the border.
[32] Florida Governor Ron DeSantis was one of the first.
[33] Here's a bit from a video he put out.
[34] If the Constitution was originally understood to mean that a state could not protect itself against an invasion.
[35] That the federal government could force a state to allow an invasion.
[36] The Constitution would have never been ratified in the first place.
[37] Texas would have never joined the union when it did.
[38] Meanwhile, pressure is coming from the left for Biden to assert control at the border.
[39] Congressman Joaquin Castro of Texas and others say Biden needs to use his authority as president to take over the Texas National Guard.
[40] They are currently stationed along the border under Abbott's orders.
[41] Now, what's the situation like at the border itself?
[42] The Daily Wire, Spencer Lindquist, actually traveled to Eagle Pass this week to get a firsthand look at what's happening on the ground.
[43] The atmosphere here at the park has totally changed since I was last here in May. Back then, almost anyone could access the park, but now the National Guard, which is working in conjunction with the Texas Department of Public Safety, has totally sealed the entrances to Shelby Park.
[44] But despite the showdown that we're seeing in the media and the courts between Governor Abbott and the White House, there really doesn't seem to be much tension between the National Guardsmen and the Border Patrol agents.
[45] A lot of these agents know each other, and there doesn't seem to be any animosity.
[46] That being said, the Texas National Guard does seem to be doubling down.
[47] I saw trucks loaded with concertino wire entering the park, and Texas National Guard engineers reinforcing the barriers and putting up more razor wire.
[48] And keep in mind, the Biden administration is given a deadline of today, saying that the National Guard must give Border Patrol access to Shelby Park.
[49] And it isn't clear what exactly will happen once that deadline arrives.
[50] And what have we heard from the White House so far?
[51] Yeah, we heard from national security spokesman John Kirby on Thursday.
[52] He told Fox News that the blame is on Congress.
[53] I mean, he has taken some executive actions, but there's a limit to what executive action can do, and we really need support from Congress.
[54] We really need additional legislative action here, new laws.
[55] And White House press secretary, Corrine John Pierre, was asked whether President Biden would take control of the Texas National Guard on CNN.
[56] She sidestepped a direct answer to that and went on to criticize Abbott's handling on the issue.
[57] He wants to politicize an issue, and he's not helping communities.
[58] He actually isn't.
[59] And he's actually putting border patrol agents in harm's way by doing what he's doing.
[60] I'm not going to speak to any actions that the president might take, may not take, but we've been very clear on this.
[61] Now, have we heard any more from Abbott since he put out that statement on Wednesday?
[62] Yeah, here he was on Fox News Thursday morning, saying that none of what he has done so far stretches his authority violates federal law or that Supreme Court ruling from earlier.
[63] this week.
[64] There's really only one person in America not doing their job, and that's the president of the United States who's not enforcing immigration laws.
[65] Also, as she has already been called out, and the president and other Democrats and media, they have cast a false narrative about some people dying on the border that apparently Texas denied Border Patrol access to has been completely debunk.
[66] The only thing that the spokesperson for Biden can do is to cast aspersions and lies, hoping that people will believe them.
[67] Because the truth of the matter is, what Texas is doing is what Americans expect to be done.
[68] Americans expect the border to be secured because Joe Biden has abandoned that responsibility.
[69] Texas is stepping up and put in it with all that razor wire that you're showing right now.
[70] Well, in our next segment, we're actually going to hear from a legal expert about that ruling and what it means for Texas.
[71] Tim, thanks for reporting.
[72] Good to be on.
[73] As we start this presidential election year, should get ready.

[80] The showdown in Texas follows a controversial ruling by the Supreme Court that's raised a lot of legal questions and misconceptions about what Texas can and can't do to try to secure its own border.
[81] Joining us to clear up the legal facts about the high court's ruling is Laura Reese, director of the Border Security and Immigration Center at the Heritage Foundation.
[82] Laura, thanks for coming on.
[83] Oh, my pleasure.
[84] Now, it's been widely reported in the media that the Supreme Court ruled against Texas's use of razor wire at the border.
[85] Is that actually correct?
[86] What did the ruling actually say?
[87] So the Supreme Court wrote just a few lines and all it did was vacated the injunction.
[88] So keep in mind, Texas brought this lawsuit against the Biden administration for trespassing on Texas city and private property, not federal property, and for destroying the razor wire that Texas had put in place.
[89] And the district court found the facts in Texas's favor, but thought that the federal.
[90] government was immune from suit.
[91] So Texas appealed that to the Fifth Circuit Court of Appeals, which said the district court got it wrong.
[92] And the Fifth Circuit issued an injunction saying, not only federal government, can't you enter this property and cut the wire, but you need to stop doing it right now.
[93] So it's that timeliness issue.
[94] Then the Biden administration appealed that to the Supreme Court.
[95] And the Supreme Court said, you can cut the wire federal government.
[96] And And we don't have to wait for the merits to play out on that timeliness issue.
[97] So at the same time, Texas can continue to put wire in place.
[98] So how it all shook out in the end was that feds can continue cutting wire and Texas can continue putting up new wire.
[99] That is correct.
[100] And what did Governor Greg Abbott say in response to that?
[101] So he issued a statement on the 24, basically saying the compact between the federal government and the states has been broken by the Biden administration, that the federal government has an obligation under the Constitution to protect the states, in this case, to enforce the immigration laws that the Congress has passed.
[102] And this administration has refused to enforce those laws.
[103] And so Governor Greg Abbott has invoked the invasion clause of the U .S. Constitution, and he is basically calling on other states to stand with him, and they are.
[104] The last count I saw was up to at least 16 states at this point, saying they stand with Texas.
[105] Now, what does that mean?
[106] Is it just words at this point?
[107] Are other states going to send their guard to Texas?
[108] Some already have over the past three years.
[109] So things are happening rapidly.
[110] This is a new territory for federal government and the same.
[111] States.
[112] Now, regarding the invocation of the invasion clause, no doubt that will eventually end up at the Supreme Court, what are the arguments that each side will make?
[113] This is a novel legal issue.
[114] And so, you know, some lawyers ask, well, what did the framers of the Constitution mean when they wrote the word invasion?
[115] Was it just an army?
[116] Was it people dressed in uniform and carrying visible guns crossing our border?
[117] Is that the only narrow definition?
[118] of invasion that should be used, or is it broader than that when our adversary these days may be sending intentionally thousands, if not more, of single adult, military -aged men into our very open border right now?
[119] So that's the question that would be before the court, and we haven't had this issue before.
[120] All right, well, Laura, thank you so much for coming on.
[121] My pleasure.
[122] That was Laura Rees, director of the Heritage Foundation's Border Security and Immigration Center.
[123] Illegal migrants are now being sheltered at two international airports in major U .S. cities, first Chicago and now Boston.
[124] Daily Wire investigative reporter, Marade, Alorty, is here with the details.
[125] So, Marade, what's the situation in Boston?
[126] Hi, Georgia.
[127] Well, the city has now run out of room at shelters for all the migrants who are arriving.
[128] Now, one terminal at Boston Logan International Airport has turned into a temporary migrant shelter for nearly 100 migrants.
[129] Some families have been sleeping for weeks in Terminal E where most international flights arrive.
[130] To make the situation more frustrating, Terminal E is the city's long -anticipated new terminal that only opened in November.
[131] And since then, the upscale terminal has been housing migrants every night.
[132] Photos show families sleeping on the floor and on pallets, crowded by other people, blankets, and their belongings.
[133] One woman collected hygiene items for the migrants, telling WBZ that the migrants, many of whom have young children, do not have access to a shower, so they are given wipes to clean themselves while they wait.
[134] Some migrants are also camping out in conference rooms at a transportation building in Boston, but that space is only available at night.
[135] Now, has the governor commented on the long -term plan for this situation?
[136] Well, Governor Mara Healy declared a state of emergency back in August and activated 250 state national guard members to aid shelters in hotels that are, housing migrants.
[137] In the fall, Healy also capped the shelter system at 7 ,500 families despite Massachusetts' right to shelter law.
[138] Now, 600 families are on a wait list for shelter.
[139] Then earlier this week, Healy and eight other Democratic governors wrote to the Biden administration and congressional leaders asking for more funds to handle the migrant crisis.
[140] She also demanded Congress help during her state of the state speech last week.
[141] While Massachusetts did not create this problem, we're going to continue to demand that Congress take action, to fix the border, to get us funding.
[142] Healy's office estimates that migrants will cost the state $915 million next year.
[143] She's asked the state legislature for another $250 million to address the crisis this year, but that funding has not been approved yet.
[144] On Monday, she thanked the airport for being a wonderful partner and said Massachusetts state police officers are being paid overtime to patrol the area of the airport where migrants are staying.
[145] Meanwhile, though, the CEO of the airport called the migrant situation not sustainable back in November.
[146] Massport interim CEO Ed Franny said they try to help the migrants when they arrive at the airport, but that it's not an appropriate place to house people.
[147] Now, how does this compare to the situation at Chicago's O 'Hare International?
[148] Well, Chicago has significantly more migrants.
[149] The numbers in Boston, Logan, haven't been clearly reported.
[150] Some sources say it's dozens, others saying it's at least 100, whereas Chicago was housing approximately 500 recent arrivals in their airport, and that includes babies and the elderly.
[151] That was reported in October.
[152] The city was using a shuttle bus center at the Chicago airport's terminal one, and the migrants were reportedly sleeping on cardboard and using airport bathrooms.
[153] Now, speaking of airports, there was a controversial post being shared online from Miami International.
[154] What was that about?
[155] That's right.
[156] So commentator Dave Rubin circulated an image of signage in Miami International Airport that appeared to give non -U
