[22] Two major moments occurred in New York on Monday in a pair of legal cases against former President Donald Trump.
[23] We saw developments in both the civil fraud case and the Stormy Daniels hush money case, with Trump appearing at a hearing in the latter.
[24] Here to discuss what we saw on Monday in both legal matters is Daily Wire contributor David Marcus.
[25] Hey Dave, so let's start with the fraud case.
[26] Trump had what's being broadly viewed as very good news for him there, right?
[27] Morning, John, and yes, a couple hundred million dollars worth of good news, in fact, as an appellate court reduced the bond he must put up to appeal the case from about $450 million, down to a measly $175 million.
[28] I can't.
[29] That's still an enormous amount of money for anyone, but should be low enough that Trump has a much easier time covering it before New York Attorney General Letitia James can start going after his bank accounts or properties, which she technically got the green light for at midnight on Tuesday.
[30] So after a few breathless weeks, we will not see the dramatic seizure of Trump properties that many people have been so excited for.
[31] Trump had this to say on Monday thanking the appellate court and adding a few choice words for Judge Arthur and Goran.
[32] I thank the appellate division for acting quickly, but Judge Engoran is a disgrace to this country, and this should not be allowed to happen.
[33] Now, did the appellate court also address whether Trump and his sons will be allowed to do business in New York as they appeal?
[34] Yes, and another big win for Team Trump on that count, as they are cleared to do business and take out loans in New York.
[35] though the Trump organization is still technically under control of a former judge who's the monitor on the businesses, there was also a bit of a sigh of relief in the New York business community, especially in real estate, that these draconian measures had been walked back a bit.
[36] Yeah.
[37] Now, regarding the Stormy Daniels hush money case, the news for Trump was not so good.
[38] What did we learn about the schedule for that trial?
[39] Yeah, you win some and you lose some.
[40] And on Monday, the judge in that case ruled against Trump's.
[41] attorneys' efforts to delay the trial or even to dismiss it.
[42] So as a result, jury selection is set for April 15th.
[43] Reports said there were testy exchanges and the judge was annoyed by the Trump team delay tactics.
[44] This is widely considered the weakest or least important of the Trump cases, but it will likely feature testimony from figures like former Trump fix -at man Michael Cullen and Stormy Daniels herself.
[45] And should he be convicted, it would be a test for some polls that show voters saying they'd move away from Trump if he's found guilty in one of these trials.
[46] Right.
[47] Now, will this trial effectively keep Trump off of the campaign trail starting next month?
[48] And if so, how long could that go on?
[49] I mean, it can and will.
[50] Unlike some of the other cases he's faced, Trump has to be in the defendant's chair every day.
[51] And so aside from a few days off and weekends, he will not be able to crisscross the nation in the way the presidential candidates tend to, and it could go on for a month or more.
[52] Politically, what could the implications of Monday's rulings be on the state of the presidential race?
[53] So for an appeals court to slash that amount, certainly buttresses Trump's cardinal allegations.
[54] The Stormy Daniels trial, that's harder to read, and we'll just have to wait and see.
[55] Yeah, but apparently we won't have to wait for long.

[65] While the 2024 race will likely come down to Joe Biden or Donald Trump's third -party candidate Robert F. Kennedy Jr. continues to raise millions of dollars and attract a sizable portion of voters.
[66] Here with the latest on what it means for the general election and which party stands to benefit is Daily Wire senior editor Cabot Phillips.
[67] So Cabot third -party candidates generally don't get more than about one or two percent of the vote.
[68] Could this cycle be different?
[69] Yeah, you're right.
[70] So in modern political history, third -party candidates have typically been nothing more than an afterthought.
[71] Yes, there was Ross Perrault who pulled in nearly 20 % back in 1992, but over the last five cycles, the top third -party vote -getter has averaged only 1 .5 % on election day.
[72] But this year is different.
[73] Robert F. Kennedy, Jr., the son of RFK and nephew of former president JFK, has built up a sizable base and maintains double -digit support in virtually every national poll.
[74] The latest from Harvard has him at 17%.
[75] Royder's 8%.
[76] 18%.
[77] Some polls earlier in the year even had him reaching the low 20s.
[78] All signs at the moment point to RFK playing a significant role in this race for the long haul.
[79] So what's different about RFK than past third party candidates?
[80] Well, perhaps the most important is the fact that he has near universal name recognition.
[81] Third party candidates typically spend most of their money simply trying to make people aware of their existence.
[82] But Kennedy, who obviously benefits from the family brand, has no such problems.
[83] He's also benefiting for voters who say that they're simply tired of both Trump and Biden and are willing to look elsewhere this year.
[84] A recent Wall Street Journal poll, for example, found that one in five Americans say they're now willing to vote third party.
[85] That is a significant jump up from years past.
[86] Kennedy is also vastly outpaced his predecessors in fundraising.
[87] At latest count, his campaign and affiliated SuperPack had brought in $50 million.
[88] That is funding efforts to get him on the ballot in all 50 states, as well as the much -discussed campaign ad he ran during the Super Bowl.
[89] And it's also worth noting, much of his donor base is comprised of voters who have not typically been all that politically active.
[90] According to Politico, 74 % of donors who gave him at least $200 did not make any contribution in 2020.
[91] So the big question, though, who is he going to pull the most votes from?
[92] Yeah, that is, it's interesting to look at.
[93] So based on the data we have so far, Kennedy is polling folks from both parties, but he is getting slightly more support from those on the left.
[94] To that point, polling shows that in a two -way race, Donald Trump leads Joe Biden by around two points on average.
[95] However, when Kennedy is added to the ballot, Trump's polling advantage jumps to five points on average.
[96] Remember, Joe Biden won Arizona, Wisconsin, and Georgia by a combined 40 ,000 votes in 2020.
[97] But in that case, third -party voters only accounted for around 1 % in each of those states.
[98] So if this year is anywhere near as tight and Kennedy is, in fact, disproportionately drawing Democrats, it would only take 10 or even 5 % of the vote to flip things for Trump.
[99] So if that's the case, how are Democrats responding to that potential threat?
[100] Well, there's definitely been a noticeable shift lately.
[101] They went from sort of ignoring his candidacy in the early days to now launching a multimillion dollar effort to discredit him.
[102] The Democratic National Committee has begun hiring party operatives for an anti -third party operation.
[103] Their message is that a vote for RFK is a vote for Trump.
[104] The DNC has also filed FEC complaints against his campaign, claiming he broke campaign finance law.
[105] The White House has also taken not so subtle jabs at Kennedy.
[106] On St. Patrick's Day, for example, President Biden posed for a photo with more than 50 members of the Kennedy family, as other White House officials have pointed out the fact that many from the famous Kennedy clan have disavowed his campaign.
[107] For their part, Republicans initially went after Kennedy.
[108] The Trump campaign last year, for example, called his campaign a, quote, vanity project.
[109] But as he's seen, grown in popularity of the Democrats, they've started to hold their fire.
[110] So while RFK has no real shot at winning in November, he is certainly getting plenty of attention from voters and now party leaders and candidates themselves.
[111] He'll also be announcing his pick for vice president today in Oakland.
[112] So one more thing to keep an aisle.
[113] Well, just anecdotally, it does seem like a lot of people like him.

[116] In a move interpreted as a win for Hamas and a blow to the relationship with Israel, The U .S. abstained Monday from voting on a United Nations resolution calling for a ceasefire in Gaza, allowing it to go through.
[117] Joining us to discuss is Ari A Lightstone, former senior advisor to the U .S. ambassador to Israel.
[118] Hi, Ariya.
[119] So this is the first time the U .S. did not use its veto power to stop a U .N. ceasefire resolution.
[120] What's the significance of the U .S. abstaining from the vote?
[121] Well, even more than that, John Kirby said they were trying to get to yes on the vote.
[122] So this is the worst of all worlds.
[123] They've indicated that they wanted to get to yes, which is ceasefire without linkage to hostage release.
[124] And then abstaining has demonstrated that there is what Obama said.
[125] There must be daylight in between us, the United States, America, and Israel.
[126] And that projects enormous weakness from the United States of America.
[127] And unfortunately, also hurts our ally Israel in a meaningful way.
[128] What terms did the resolutions specify?
[129] Was it a big win for Hamas?
[130] Well, Hamas congratulated the ceasefire.
[131] resolution.
[132] So they perceive it to be a big win.
[133] And in the Middle East, perception, indeed really is reality.
[134] The resolution said three things.
[135] It said that there should be unconditional ceasefire, at least for the remaining part of Ramadan.
[136] It did say that there should be the release of hostages and that there should be medical treatment for the hostages, which in and of itself is contradictory.
[137] If the hostages are going to be released, you don't need the Red Cross.
[138] You just need to get them home to actual Israeli hospitals.
[139] So it's weak need and filled with, you know, moral equivalencies in between Israel and Khamas.
[140] And when the United States of America sits on the sidelines, that Iran, China and Russia are the ones who step up to, quote, lead.
[141] In protest of the UN vote, Israeli Prime Minister Benjamin Netanyahu canceled a scheduled diplomatic visit to Washington.
[142] What are the prime minister and Israelis thinking right now?
[143] Well, actually, the mood on the street this afternoon was probably the lowest it's been in terms of approval rating in Israel for President Biden since the high when he landed here the first couple days of the war.
[144] There was a meaningful sense of abandonment and really disappointment that holy cow, perhaps the United States of America and Israel are not truly on the same side because you cannot be neutral at the United Nations.
[145] You are either in favor of the elimination of Hamas or you're in favor of Khamas winning.
[146] And if Khamas wins, that means that Israel will have lost this war.
[147] Has the Biden administration's support for Israel deteriorated in recent months?
[148] And what's the significance of that?
[149] Well, I think the United States of America, more clearly, Joe Biden, his advisors have prioritized 100 ,000 voters in Dearborn, Michigan over the full faith and credit of the United States of America around the world.
[150] The weakness, Israel will figure this out.
[151] Israel can win a war in Gaza, Israel can win a war on its northern border.
[152] Casballa with or without the United States of America.
[153] Every other country in the world today is looking and saying the United States of America's word is worthless and it will not be there for that ally when the chips are down.
[154] And that weakens us as Americans around the world immeasurably.
[155] What about the confidence level in Israel's campaign to wipe out Hamas?
[156] How are Israelis feeling about that?
[157] It's 101 out of 100.
[158] The Israeli people know that they will defend themselves by themselves, and if America will not provide the weapons that Israel is prepared to pay for, they will get the weapons elsewhere, even if that means making them themselves.
[159] Israel used to believe that it and the United States of America stood on the side of good, protecting the West from evil, and now it believes that the United States of America is actually weighing in on the side of Hamas.
[160] and Israel knows that it will defend itself by itself even if the United States of America counts itself as one of its foes.
