[4] It's Thursday, May 16th, and this is your Morning Wire afternoon update.

[5] New data shows that the number of illegal immigrants evading Border Patrol has skyrocketed under President Biden.

[6] The new data was obtained from a FOIA request made by Fox News.

[7] The numbers show that between 2010 and 2020's fiscal years, there were over 1 .4 million gotaways, but under Biden, there have already been around 1 .6 million gotaways.

[8] That's more gotaways in just three years than the entire decade before.

[9] The Dow Jones Industrial Average made a historic jump this morning.

[11] The Dow surged past 40 ,000 today, hitting a record high that marks the culmination of a bull run that started back in October of 2022.

[12] The news comes amid strong earnings reports and optimism that the Fed will cut interest rates before years end as inflation begins to slow.

[13] Traders have pushed the Dowell near 40 ,000 earlier in the year, but it cooled as high interest rates took hold.

[14] Retail giant Walmart helped lead the charge jumping 6 % after posting stronger than expected first quarter earnings.

[15] President Biden is using executive privilege to keep audio recordings of his interview with Special Counsel Robert Her out of the hands of congressional Republicans.

[16] Daily Wire reporter Tim Pierce has more.

[17] Garland informed Congress of this today as GOP leadership threatened to hold the Attorney General and contempt for refusing to hand over the tapes.

[18] The Justice Department has released the interview transcripts but has held off on the audio from her's interview with the president.

[19] In his investigation, Her concluded that the president did mishandle documents but did not think criminal charges were necessary.

[20] In his report, her referred to Biden as a well -meaning, elderly man with a poor memory, Dealing a blow to the president whose age and mental acuity have often been called into question.

[21] In a letter to House Oversight Committee Chairman James Comer and Judiciary Committee Chairman Jim Jordan, a White House lawyer said the president only asserted executive privilege at the request of the Attorney General.

[22] Speaking to reporters outside his office, Garland called the request for the tapes illegitimate.

[23] We have gone to extraordinary lengths to ensure that the committees get responses to their legitimate requests.

[24] But this is not one.

[25] To the contrary, this is one that would harm our ability in the future to successfully pursue sensitive investigations.

[26] There have been a series of unprecedented and, frankly, unfounded attacks on the Justice Department.

[27] This effort to use contempt as a method of obtaining our sensitive law enforcement files is just the most recent.

[28] A contempt of Congress resolution against Garland would have to go to a full House vote.

[29] If it passes, the DOJ is almost certain to ignore it and decline to prosecute its leader.

[33] Harvard University failed to address anti -Semitism on campus.

[34] That's according to a congressional report released today.

[35] Daily Wire reporter Megan Basham reports.

[36] The House Committee on Education and the workforce found that the Ivy League school did not properly investigate anti -Semitic harassment following Hamas' October 7th terror attack on Israel.

[37] The university also ignored recommendations from its anti -Semitism advisory group.

[38] Congresswoman Virginia Fox said Harvard used it all for show.

[39] Some of the acts Harvard failed to discipline included Jewish students being spat on, and stocked, as well as messages like gas all Jews being posted to a Harvard social media chat board.

[40] The school's office of equity, diversity, inclusion, and belonging did not respond to complaints about anti -Semitism.

[41] The committee began its investigation after Harvard came under public scrutiny for a letter that was signed by over 30 student organizations describing Israel as being, quote, entirely responsible for Hamas's terror attack.

[42] The Supreme Court ruled 7 -2 today to reject a challenge to the Consumer Financial Protection Bureau.

[43] Daily Wire's senior editor, Joel Needler, has the latest.

[44] A group of payday lenders originally brought suit to the CFPB in 2017 after new regulations limited their ability to automatically withdraw payments.

[45] In 2022, the Fifth Circuit Court of Appeals sided with the lenders ruling that the Bureau's method of funding was unconstitutional, thus making their regulations invalid.

[46] The CFPB draws funds directly from the Federal Reserve, evading congressional oversight.

[47] The Supreme Court's decision today reverses the Fifth Circuit ruling.

[48] Justice Clarence Thomas wrote the majority opinion, saying, quote, the Bureau's funding mechanism fits comfortably with the First Congress's appropriations practice.

[49] Justices Samuel Alito and Neil Gorsuch dissented citing the Constitution's appropriations clause.

[50] Legal expert Jessica Levinson said the following to CBS about the ruling.

[51] It's fascinating to me because the majority here is written by somebody who is an originalist or a textualist.

[52] The dissent is written by Justice Alito, somebody who's an originalist or a textualist, and they just completely disagree on what the appropriations clause in the Constitution actually allows.

[53] So it's significant because it means that the Consumer Financial Protection Bureau lives to fight another day.

[54] If the court had gone the other way and said there's a problem with their funding source, that obviously could have been fatal for the agency.

[55] Vice President Kamala Harris has accepted an offer for a vice presidential debate the Biden campaign announced today.

[56] The debate will take place on CBS either July 23 or August 13th, far ahead of the typical October timeframe.

[57] Trump's campaign has not yet publicly accepted the invitation, though the former president has yet to pick a running mate.

[58] The announcement comes a day after Biden and Trump agreed to, debate on CNN and ABC in June and September, respectively.

[59] The VPs will face the same guidelines outlined for those debates, including no in -person audience, firm time limits, and microphones being muted when not answering a question.

[60] And a North Carolina bill banning most public mask wearing passed the state Senate yesterday, with Republican lawmakers citing recent crime.

[61] The bill would repeal a COVID -era law that allowed wearing masks in public for health and safety reasons.

[62] It would also raise penalties for wearing a mask while committing a crime and for blocking roads or emergency vehicles while protesting.

[63] Opponents expressed concerns about immunocompromise people, but Bill's sponsor Buck Newton said police have discretion on when to charge someone and will only focus on criminals who mask to conceal their identity.

[64] This was not a problem pre -COVID.

[65] We didn't see Granny getting arrested in the Walmart, I trust people's good common sense.

[66] I trust law enforcement's good common sense.

[67] The bill continued along party lines and is expected to hit the house floor in the coming weeks.
